Payment Provider: Payments for our Services are processed via Stripe, a third-party payment provider. By purchasing our Services, you agree to Stripe’s terms and conditions.
Subscription Model: Our Services are offered on a subscription basis with no obligation to stay, meaning there is no contract or long-term commitment. You are free to cancel your subscription at any time through your account settings or by contacting us, subject to our cancellation policy (see Section 4).
Merchandise: Payment for merchandise is due at the time of purchase and is non-refundable unless otherwise stated.
Service Subscriptions: To cancel your subscription, you must notify us at least 3 working days before your next payment is due. If you fail to provide this notice, your subscription will continue, and you will be charged for the next billing cycle.
Merchandise: All merchandise sales are final unless the product is faulty or damaged upon delivery, in which case you may request a replacement or refund within 14 days of receiving the product.
Health and Fitness Requirements: By purchasing any of our Services, you confirm that you are physically and medically fit to participate in the chosen program. It is your responsibility to ensure that you have no pre-existing medical conditions or injuries that may be aggravated by physical activity.
Non-Disclosure of Health Conditions: Evolve Performance is not responsible for any harm, injury, or adverse effects resulting from undisclosed medical conditions or injuries. You agree to consult with a healthcare professional if you have any doubts about your ability to participate in our programs safely.
All content provided through our Services, including but not limited to programs, coaching materials, videos, and merchandise designs, is the intellectual property of Evolve Performance or its licensors. You may not reproduce, distribute, or modify any content without our express written consent.
Evolve Performance is not liable for any indirect, incidental, or consequential damages arising from the use of our Services. This includes, but is not limited to, injury, loss of data, or financial loss.
You agree that the results from using our Services may vary, and we do not guarantee any specific outcome. You acknowledge that participation in physical training involves inherent risks, and by purchasing our Services, you assume full responsibility for any injury or damage that may occur.
We reserve the right to terminate or suspend your access to our Services at any time, without notice, if you breach these Terms or engage in any behaviour that we determine to be inappropriate or harmful.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to the Site or our Services will be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of our Site or Services after any changes indicates your acceptance of the revised Terms.
